Under the FMLA, federal and state employees and those who work for employers with 50 or more employees are able to take up to 12 weeks of unpaid leave in order to care for an ill child, parent, or spouse, or for one's own serious illness, without fear of losing their job, benefits, or status. Unpaid leave can also be taken for the birth or adoption of a child, or when placing a child for adoption or foster care. Both working men and women are protected by this legislation.
