Answer to Question 1

Tory and Jack have just gotten divorced. The judge had ruled in the case that the children could choose which parent they wanted to live with.
This is an example of a split divorce. In split custody, the children are divided between the parents either by sex (the mother gets the daughters and the father gets the sons) or by choice (the children are allowed to choose the parent with whom they want to live).

Answer to Question 2
