Under the law the employer's only obligation is to review documents and to complete and retain Form I-9 . If the prospective employee offers approved documents that satisfy the INS regulations, such as a driver's license and social security card, it is the employer's task only to examine the documents to verify that they reasonably appear on their face to be genuine. The employer should not insist on preferred documents, such as a U.S. passport, certificate of naturalization, or a green card, when a person sounds foreign. Such is beyond their responsibility and is in violation of the IRCA.
