Yes, employers providing references are presumed to be acting in good faith, unless the plaintiff can show a lack of good faith on the part of the defendant by clear and convincing evidence, which is a heavy burden of proof for civil litigation. The presumption of good faith is rebutted only upon showing by clear and convincing evidence that the employer knowingly provided false information or the employer made the reference maliciously.
