An employer can only monitor the personal calls of employees to the extent necessary to guard against unauthorized use of the telephone or to determine whether the call is personal. Once the call is determined to be personal, the employer must stop listening immediately. The employer may confront the employee with the fact that a personal call was made or received in violation of company policy, and the employer may take appropriate disciplinary procedures to enforce its business rules.
