One provision of the CBA referred to drug use and another provision referred to the use of surveillance videotapes in certain specified circumstances. However, neither provision of the CBA purported to have any bearing on secret spying on employees in company restrooms.
The Court states its belief that the real reason behind the company's assertions that the CBA was controlling is that it was trying to inject a federal question into a state-law claim in order to transform the action into one arising under federal law. And the Court refused to reward such an exercise.
