Answer to Question 1

F

Answer to Question 2

The Court of Appeals was in error requiring a complete expectation of privacy and the Supreme Court of California remanded the case to that court for further proceedings. The Supreme Court held that an employee may, under some circumstances, have a reasonable expectation of visual or aural privacy against electronic intrusion by a stranger to the workplace despite the fact that the conversations could be witnessed by coworkers or the employer.
