The answer is yes. Employers may be very reluctant to hire or retain employees with any record of violence in their past, lest the employers be held liable for negligent hiring or retention of the employees in question.
The dissenting opinion raises the very strong pubic policy position that individuals who have committed a crime of violence and have been rehabilitated should have the opportunity to be productive citizens. And, it may be good for society in general if the employer rather than to permanently dismiss an employee who is involved in an on-duty or off-duty altercation, to suspend that individual until he or she is evaluated and successfully completes a remedial program through an Employee Assistance Program.
