The employer told Rhodes that he was being fired because of a RIF in the hope that he would accept this as a legitimate business reason and go away.. The employer placed a memo about Rhodes's lack of expertise in downhole operations to rationalize or build a case for a legitimate business reason for the termination, if challenged. The CYA letter reference by the supervisor shows recognition by management that the employer could be exposed to legal liability by terminating an older worker. However, when a CYA letter is all that a supervisor can come up with and the real reason for the termination is age, the supervisor is not serving the interest of the employer by creating such a record.
