Answer to Question 1

F

Answer to Question 2

The decision does not set forth conclusive testimony on this point. However, sales were bad, and McMorrow determined that the field sales had inferior management. Gfeller and McMorrow apparently believed that younger people were more aggressive and would be better able to adapt to new procedures. Also, younger employees with fewer fixed expenses than older employees may be willing to work for and be satisfied with less compensation. Experienced employees with cumulative annual increments tend to be paid more money.
Gfeller and McMorrow, however, had not only lost sight of the ADEA and the great economic liability the employer would suffer as a result of their decisions, but seem not to have understood the value of the energy, experience, contacts, and seasoning of older employees for their employer's sales efforts.
