The Supreme Court disagreed. The majority opinion of the Court, written by Justice Stevens, reversed the Fourth Circuit, pointing out that the Fourth Circuit recognized that the EEOC never agreed to arbitrate its statutory claim, and that the EEOC had independent statutory authority to vindicate the public interest. The Court determined the EEOC had the right to pursue a full range of remedies in court for an individual who failed to pursue arbitration, and is not limited to just injunctive relief.
