Answer to Question 1

Congress in Section 703(d) had forbidden all forms of discrimination. The Supreme Court was faced with a choice of either allowing some programs that departed from the literal standards and language set down by Congress or of perhaps defeating the purpose of Title VII if the Court were to disallow affirmative action plans. It made a choice to allow voluntary affirmative action programs.
