Explain how an employer can be found to have aided in the agency relation and thus be liable for damages when the employer had no idea that a supervisor had turned down an employee for a position because the employee had rejected a sexual proposal.

Answer to Question 1

The supervisor was empowered by the employer to make the economic decision in question. It was a tangible employment action taken on behalf of the employer. Without the supervisory authority having been graded by the employer, the injury in question that of obeying improperly turned down for promotion, could not have happened. Absent the agency relationship, the harm would not have occurred. As such, the employer is liable for the actions of the person it empowered to cause the harm.
