Answer to Question 1

The Court points out that the regulation does not require the employer to pay employees under such circumstances. The Court states that the regulation does, however, provide that the employer may not discriminate against the employees involved. The Court states that an employer discriminates when it treats an employee less favorably than it treats other similarly situated employees. The Court does not reach a conclusion on whether Whirlpool discriminated against the two employees by not paying them for the six hours of work they lost because of their refusal to follow their supervisor's directive.
