Yes. The Act's general duty clause requires an employer to furnish a workplace free from recognized hazards that are causing or are likely to cause death or serious injury to employees. Since OSHA inspectors cannot be present around the clock in every workplace, the Secretary's regulation ensures that employees will, in all circumstances, enjoy the rights afforded them by the general duty clause.
