Answer to Question 1

Certainly. In the instant case the ALJ had reason to question the credibility of the employer's witnesses' version of the facts in light of the additional facts presented to the ALJ about Bedell's past employment relationship with his supervisors, which evidence was not presented to the arbitrator.
