Answer to Question 1

Employees who engage in an economic strike have protection developed from the Fleetwood and Laidlaw cases. In a nutshell, these cases require a company to reinstate economic strikers (who have been replaced by permanent replacements or whose jobs have been abolished because of low production levels caused by a strike) when jobs become available. Unfair labor practice strikers have an unlimited right to reinstatement.
