Answer to Question 1

The construction industry exception to the Section 8(e) prohibition on hot cargo provisions in collective bargaining agreements continued an acceptable status quo in the industry  this was how the industry was successfully operating in 1959 without the problems associated with closed shops in other industries; and it would prevent friction on job sites between union and nonunion workers or members of different unions.
