Answer to Question 1

The dissenting justices believe that the Board should have waited until the full work force had been employed. If the Board had waited, in this case, until April 15, 1983, less than a majority of predecessor employees would have been found to be working for Fall River.

Answer to Question 2

The Board applies a substantial and representative complement rule to fix the moment when the determination of majority status is made.
