The New York concern was controlled by Roger Milliken and his family. The Milliken family operated 17 textile manufacturers with 27 different mills. The Textile Workers Union won an election at Darlington, and the board of directors of Darlington then voted to liquidate the corporation. The union charged that this action was a violation of Section 8(a)(1), (3), and (5).
