Answer to Question 1

Yes. It was the employer's idea to create the Action Committees. The employer drafted the written purpose and goals of each committee, determined how many members would compose a commit-tee, and imposed a one-committee limit per employee and appointed management representatives to each committee. It also supported the committees by financial and other support contrary to Section 8(a)(2), since it permitted the activities to be carried out on paid time, and provided materials needed.

Answer to Question 2

Section 8(a)(2) makes it an unfair labor practice for an employer (1) to dominate in the formation or administration of the organization, (2) to interfere with the formation or administration of the organization, or (3) to assist the organization by contributing financial or other support.
