Answer to Question 1

The sentence was not a forgery. And the voters would easily recognize it as propaganda. No justification existed for the court to set aside the election.

Answer to Question 2

The rationale for the decision is that employees are mature individuals who are capable of recognizing campaign propaganda  and discounting it.. Shopping Kart 228 NLRB 1311, 1313 (1977).
