Were the employees' right to free and fair choice affected by the focus sentence beginning with THE U.S. SUPREME sic HAS HELD because the misrepresentation was so pervasive and the deception so artful that employees would not be able to separate the truth from the untruth?

Answer to Question 1

The sentence was not a forgery. And the voters would easily recognize it as propaganda. No justification existed for the court to set aside the election.

Answer to Question 2

The rationale for the decision is that employees are mature individuals who are capable of recognizing campaign propaganda  and discounting it.. Shopping Kart 228 NLRB 1311, 1313 (1977).
