Answer to Question 1

The Regional Director must follow the precedents set by the Board, and does not have the discretion, or wiggle room, to try out a new or novel representation ruling.

Answer to Question 2

No. AB 1889 imposes a targeted negative restriction on employer speech about unionization and does not even apply this constraint uniformly. AB 1889 exempts expenses incurred in connection with, inter alia, giving unions access to the workplace, and voluntarily recognizing unions with a secret ballot election.
