What is willful violation?

Question 2

In rem jurisdiction gives state courts jurisdiction to:
 a. resolve disputes over property located in a neighboring state

Answer to Question 1

The Supreme Court discussed the definition of willful in McLaughlin v. Richland Shoe Co. and defined willful as that the employer either knew or showed reckless disregard as to whether its conduct was prohibited by the FLSA.
