The wording of Sections 8(a)(3 ) and 8(b)(2 ) indicates that a violation of these sections has two elements.
First, there must be some discrimination in the terms or conditions of employment either a refusal to hire, discharge, lay off, or discipline-or a union attempt to get the employer to so discriminate.
Second, the discrimination or attempt to cause discrimination must be for the purpose of encouraging or discouraging union membership.
