Which of the following statements in a letter from a collector to a debtor would be a violation of FDCPA?
 A) We will be contacting your employer to let him know of this problem.
 B) We will file suit if payment is not made within 30 days.
 C) We will be calling you at your home.
 D) All of the above are violations.

Question 2

Alan Freeman is in the process of forming a corporation in order to protect himself from liability in the operation of his construction/development business. The business is incorporated on November 1, 2011. However, Alan was anxious to get started on a townhouse development. He signed contracts with subcontractors for the project during September and October. Discuss Alan's liability before and after incorporation.

Alan is personally liable on the contracts before and after incorporation. He can be relieved if the corporation, the subs, and he enter into a novation. He will be secondarily liable if the corporation ratifies the contract.
