Answer to Question 1

Students should discuss assignment of benefits, which is what Cage did when he made a promise of the proceeds to her. The students might also raise whether the promise had to be in writing. Absent some specific state statutes on lottery split arrangements, the agreement does not fit into any of the Statute of Frauds requirements. The students might also discuss whether the shop server was an incidental beneficiary or credit or donee beneficiary in the relationship.
