For purposes of CERCLA, the definition of owner/operator does not include a lender with just a security interest.

Question 2

X-ron Perfume is sold only in one major department store for each city. X-ron will deal only with one department store and will not sell to other stores. Are there any antitrust violations with this arrangement?

Not so long as there is interbrand competition - intrabrand competition can be limited. So, as long as there are other perfume brands being sold in the same market, X-ron can limit its sales to one store.
