The court held that enforcing suggested retail prices was not a per se violation because there were services and consumer assistance that full-service retailers provide that are not available at deep discounters Consumers have the ability to become more informed and make the choices on service when these options are there. The court held that trials must examine the effects on competition of such practices in particular markets and not just outlaw the enforcement altogether.
