Cottage Hill Realty listed the Bryant's property. The Bryants mentioned to the Cottage Hill agent that they had filed a claim against their builder for failure to treat the foundation (for termites) within two days of pouring. The Bryants anticipated chronic problems and were, therefore, selling the home, but would subrogate their claim to the buyers. The agent does not disclose this information to the buyers. Is he obligated to do so?
