The City of Jackson Heights requires all developers to pay an impact fee that is the same for all developers regardless of the size of the subdivision. Discuss whether the city's fee structure is appropriate.

Answer to Question 1

The fees have to be tied to needs that arise because of the development. If the same fees are charged regardless of size then the city is collecting fees and not tying the assessment to the need for schools, fire, police, etc.

Answer to Question 2

Jones will be liable, since the accident occurred in a common area.
