Answer to Question 1

A

Answer to Question 2

Courts generally do not intervene in fees unless there is coercion, as here, or the fees are a guise for exclusion. The court found the fees were a penalty and not used for public purposes. Ehrlich v. City of Culver City, 19 Cal. Rptr. 2d 468 (1993).
