With reference to 12, what if the state had passed a statute that prohibited the taking of property by local governments for purposes of substituting a different business in an area?

Answer to Question 1

Following Kelo, many states did just that and passed statutes that restrict eminent domain. Those statutes are valid and can require a higher standard for a taking.
