Therefore, the needs of the company must be carefully weighed against the person's right to privacy so as to avoid unwarranted invasions of that right. In particular, claims information is considered to be privileged and confidential in the context of the administrator-member relationship. Unauthorized disclosure of information may represent a violation of that confidentiality and may be prosecuted under the Health Information Portability and Accountability Act (HIPAA).
