Answer: Right-to-work laws prohibit management and unions from entering into agreements requiring union membership as a condition of employment. These laws are state statutes or constitutional provisions that ban the practice of requiring union membership or financial support as a condition of employment. They establish the legal right of employees to decide for themselves whether or not to join or financially support a union. Twenty-three states, located primarily in the South and West, have adopted such laws, which are a continuing source of irritation between labor and management. The union shop is generally legal in the United States, except in states that have right-to-work laws. The agency shop is outlawed in most states that have right-to-work laws. Employees who are members of the union at the time the labor agreement is signed or who later voluntarily join, must continue their memberships until the termination of the agreement, as a condition of employment. This form of recognition is also prohibited in most states that have right-to-work laws.
