Answer to Question 2

A
The 1898 Erdman Act was the first piece of legislation to outlaw discriminatory acts by employers
against unions. By refusing to allow all new employees to join the nursing union, the hospital is
interfering with the union's membership and the union's ability to represent all nurses employed by
the facility. The 1935 National Labor Relations Act (Wagner Act) allowed employees of private
companies to organize unions to demand better wages and safer working conditions, and the 1938 Fair
Labor Standards Act set minimum wage and maximum hours that can be paid before overtime is paid.
The 1947 Taft-Hartley Act returned some rights to management but still equalized the balance between
unions and management.
