Since the founding of the United States, governments have had the power to take private land for public purposes, even without the consent of the landowner. This power, called eminent domain, comes from English common law. State and local governments have mostly used eminent domain in cases of public needfor instance, the construction of a road or bridgeand tempered it with a right to just compensation for the landowner, usually paying the market rate for the land.
