In many cases these individuals are brought in immediately upon arrest and may be under the influence of drugs or alcohol. Also, these individuals are often brought in at night, when staff resources are most stretched, increasing the likelihood of suicide indicators being missed.

Prisoners with serious mental illnesses are usually treated by the psychiatric staff, within the prison. Prior to deinstitutionalizat ion, inmates who were mentally ill were routinely sent to state mental institutions. The change in rules governing commitment apply to both inmates and those not incarcerated. There must be strong evidence that an inmate is a threat to him- or herself or others before an inmate can be committed.
