Examples of negligence on the part of design engineers are (Sweet and Schneier, 2005):

a) Preparing defective engineering designs or drawings that are defective.
b) Not completing drawings when they are needed during construction.
c) Providing cost estimates to owners that are significantly lower than the resulting
actual costs.

Answer to Question 2

If the actions of a professional engineer are a criminal offense then the case is heard in the criminal court system. The penalties he or she would be likely to receive range from being granted probation, a suspended sentence, fines, or jail terms. In addition to criminal sanctions, there are quasi-criminal sanctions to stop an engineer from practicing such as court orders.
