Answer to Question 1

An owner may not want to be involved in a broker construction contract because they allow brokers to subcontract all of the work and the broker is not required to perform any of the work.

Answer to Question 2

A contract is void from its inception if it includes agreements that are not legal or if the subject matter is against public policy. Voidable contracts are viable until they are voided by something in the contract that surfaces during the execution of the contract that voids them such as one part to the contract being a minor or incompetent or the contract was signed based on fraudulent information or signed under duress.
