Answer to Question 1

Non-compensable excusable delays are delays that are not caused by either the owner or the contractor. They are caused by acts of God, or other unforeseeable causes, that are beyond the control of both parties. Delays that are caused by acts of God entitle contractors to receive time extensions, but not damages for the delay. Contracts usually contain a clause, sometimes referred to as a force majeure clause that lists the causes of delays that are non-compensable excusable delays.
