Why is international arbitration a better way to settle international contract disputes than litigation?

Answer to Question 1

International arbitration is a better method for settling disputes than litigation because it involves arbitrators from nations other than a host nation (the nation of owners) and the home nation of contractors. If litigation is used to settle contractual disputes it may only be carried out in the host nation or the choice of law nation stipulated in the contract.

Answer to Question 2

A reasonable percentage that a contract could be changed by an owner without it being a cardinal change is ten percent.
