In spite of all the efforts of owners, contractors, and subcontractors contract disputes still occur on construction projects. It is difficult, if not impossible, to draft construction contracts that address every potential problem that could arise during construction. Contract claims arise when there are disputes between the contracting parties or when the owner and the contractor are not able to agree that there has been a change in the original scope of work or on the degree of the change. When a dispute arises and the contracting parties are not able to quickly resolve it one of the parties will file for a change order or file a claim.
