Answer to Question 1

Statements of non-collusion indicate that a contractor has not worked with other contractors to arrive at his or her bid price. By signing a non-collusion statement contractors are verifying that they did not share their bid price with other contractors and they did not form any type of agreement with other contractors stating that one of them would bid lower on this job and the other contractors would each take turns bidding the lowest on other jobs to ensure that all of the contractors would eventually be awarded contracts.

Answer to Question 2

An apparent low bidder is the bidder that is announced as the lowest bid when bids are first opened during a bid opening before they are canvassed by the engineer to determine if the apparent low bidder is both responsive and responsible.
