A lawyer for a defendant might be able to demonstrate that their defendant performed according to the legal standard of care of their particular engineering profession by providing expert witnesses to testify as to the required standard of care for the situation that lead to the injury or death of a plaintiff.

Answer to Question 2

Engineering lawsuits that involve engineering defects might be allowed to be filed after the statute of limitations has expired in a state due to considerations related to latent defects that are not discovered by new owners of structures that purchase structures after the statute of limitations expires.
