Answer to Question 1

Discovery is used during trials so that each party to a lawsuit is aware of what the other side has for evidence and what type of testimony the opposing part will provide during a trial. It is hoped that discovery will lead to settlements if one party realizes that the opposing party has prepared a more effective case.

Answer to Question 2

Prejudgment remedies occur when a plaintiff requests that the court either seize the assets of the defendant that are in dispute, or restricts access to the assets that are being disputed, in a lawsuit.
