Answer to Question 1

Federal laws indicate that students cannot be punished for their disability. A manifestation determination must be conducted. IEPs for students with behavior disorders must include agreed-on strategies for dealing with disciplinary problems. Disciplinary actions that change a students placement are limited to 10 days. Possession of firearms or drugs is an exception, and a temporary placement can be used for 45 days. Suspension from school may be, at the least, in competition with existing IEP objectives, and so is not often recommended.
