Answer to Question 1

Although the response may reflect the student's own conception of what a deposition is, the answer should mention the fact that it is a method of bringing out factual information before the trial beginsa discovery process. Although rules and regulations are followed, questions regarding legal matters can be ruled upon before a judge, if necessary.

Answer to Question 2

Rebuttal testimony is evidence presented by the plaintiff that disputes the evidence presented in the defendant's case in chief. Surrebuttal testimony is testimony which rebuts the evidence presented by the plaintiff in rebuttal.
