In Marbury v. Madison, the Supreme Court held that the Supreme Court has the power to review statutory law to determine if it is constitutional. Judicial review is the power of the courts to review statutory law to determine if the law is constitutional.

Answer to Question 2

The Supreme Court recognized that a right of privacy exists under the penumbra of rights implied in the Constitution. The Court found unconstitutional a state statute that providing birth control information to anyone was a crime, as was using any contraceptive method. The Court held that the right to privacy is based on the rights in the First, Third, Fourth, Fifth, and Ninth Amendments.
