Answer to Question 1

There is no jury. The defendant is present, but very seldom presents witnesses.

Answer to Question 2

The pretrial conference is a conference held among the lawyers and judges; the preliminary hearing is a trial or hearing used to determine if there is enough evidence to hold a defendant for trial.
